Terms of Service

Effective Date: August 2nd , 2026

Last Updated: August 1st, 2026

These Terms of Service (“Terms”) govern your access to and use of the website operated by MHA Home Care Services LLC, doing business as MHA Home Care (“MHA Home Care,” “we,” “us,” or “our”), including www.mhahomecareservices.com and its associated pages, forms, and online features. By accessing or using our website, you agree to these Terms and our Privacy Policy. Do not use the website if you do not agree with these Terms.

1. Purpose of the Website

The website provides general information about:

  •  MHA Home Care;

  •  Non-medical home care services;

  •  Service areas;

  •  Employment opportunities;

  •  Referral relationships;

  •  Community resources; and

  •  Ways to contact our company.

Website content is provided for general informational purposes. It is not intended to replace an assessment, service plan, signed service agreement, professional medical advice, emergency assistance, or advice from a licensed healthcare professional.

2. No Emergency Services

Do not use the website, email, voicemail, contact forms, or text messages to report an emergency or request immediate assistance. If you or another person may be experiencing a medical emergency, safety emergency, abuse, neglect, exploitation, or immediate danger, call 911 or contact the appropriate emergency or government authority. Website forms, callback requests, email messages, and voicemail messages may not be reviewed immediately.

3. No Medical Advice

MHA Home Care provides non-medical home care services within the scope permitted

by its applicable Minnesota license and service agreements.

Information on this website is not medical advice and should not be used to:

  •  Diagnose a medical condition;

  •  Select or discontinue treatment;

  •  Change medication;

  •  Delay professional care;

  •  Replace instructions from a physician, nurse, pharmacist, therapist, or other licensed professional; or

  •  Make an emergency healthcare decision.

Always consult an appropriate licensed healthcare professional regarding medical questions or concerns.

4. Licensing and Service Availability

MHA Home Care will offer or provide regulated home care services only while the required Minnesota license or authorization is active and only within the scope permitted by that license.

Information describing a service does not guarantee that:

  •  The service is currently available;

  •  The service is appropriate for a particular person;

  •  A caregiver is available at a requested time;

  •  A particular caregiver will be assigned;

  •  Services are available in every listed city or ZIP Code;

  •  A requested start date can be accommodated; or

  •  MHA Home Care will accept a particular referral or client.

Services may be subject to:

  •  An initial inquiry and screening;

  •  An assessment of needs;

  •  A determination that we can safely and appropriately meet those needs;

  •  Staffing availability;

  •  Geographic limitations;

  •  Agreed schedules;

  •  Payment arrangements;

  •  A signed service agreement;

  •  A written service plan; and

  •  Other applicable admission requirements.

5. Website Inquiries Do Not Create a Client Relationship

Submitting a contact form, requesting a callback, sending an email, leaving a voicemail,

or communicating with a representative does not by itself:

  •  Establish a provider-client relationship;

  •  Create a duty to begin services;

  •  Guarantee acceptance as a client;

  •  Reserve a caregiver or service date;

  •  Create a service plan;

  •  Constitute an admission agreement; or

  •  Guarantee a response within a particular period.

A client relationship begins only after MHA Home Care completes its required admission process and the appropriate documents have been signed or otherwise completed.

6. Service Agreements Control

These website Terms govern website use only. Actual home care services will be governed by separate documents, which may include:

  •  A service agreement;

  •  A written service plan;

  •  A rate or fee schedule;

  •  A Client Bill of Rights;

  •  Privacy and authorization documents;

  •  Scheduling and cancellation terms;

  •  Payment policies;

  •  Emergency contact forms; and

  •  Other admission or service documents.

When these Terms conflict with a signed client service agreement concerning the delivery or payment of services, the signed service agreement will control for that issue. Nothing in these Terms is intended to waive or limit a client’s rights under Minnesota home care laws or other applicable laws.

7. Accuracy of Information

We strive to provide useful and accurate information, but website content may occasionally contain errors, omissions, or outdated information. We may change:

  •  Service descriptions;

  •  Service areas;

  •  Hours;

  •  Employment opportunities;

  •  Rates;

  •  Policies;

  •  Contact information;

  •  Website features; and

  •  Other content

without prior notice, subject to any notice or contractual requirements that apply to current clients. You should contact us directly to confirm information that is important to a care, employment, referral, or financial decision.

8. Rates and Payment Information

Any rates, price ranges, payment information, or examples displayed on the website are general information unless expressly identified as a binding written quote. Final rates may depend on factors such as:

  •  Requested services;

  •  Schedule;

  •  Visit length;

  •  Location;

  •  Staffing requirements;

  •  Holidays;

  •  Minimum service requirements;

  •  Level of assistance;

  •  Changes in care needs; and

  •  Other terms included in the service agreement.

Website pricing does not override a signed rate agreement, service agreement, invoice, or written notice provided to a client. MHA Home Care does not guarantee insurance, government-program, waiver, or third- party reimbursement unless expressly stated in a written agreement.

9. Employment Information

Employment information and job postings on the website are provided for general recruiting purposes. Submitting an application does not guarantee:

  •  An interview;

  •  Employment;

  •  A particular position;

  •  A particular schedule;

  •  A minimum number of hours;

  •  A particular client assignment; or

  •  Continued availability of the listed position.

Employment may be subject to interviews, references, background studies, eligibility verification, orientation, training, competency requirements, and other conditions permitted or required by law. MHA Home Care is an equal opportunity employer and will make employment decisions according to applicable law.

10. Electronic Communications

By providing your email address or telephone number, you authorize us to respond to your inquiry using the contact information you provided. You are responsible for ensuring that:

  •  The information you submit is accurate;

  •  You are authorized to use the email address or telephone number;

  •  You have permission to provide information about another person; and

  •  Your communications do not contain unlawful or harmful material.

  • Ordinary email and text messages may not be completely secure. Do not send Social Security numbers, bank information, account passwords, detailed medical records, or similarly sensitive information through unsecured communications.

11. Text Message Terms

When you voluntarily opt in to receive text messages from MHA Home Care:

  •  Messages may concern your inquiry, requested services, appointments, employment application, scheduling, or other administrative matters;

  •  Message frequency may vary;

  •  Message and data rates may apply;

  •  Mobile carriers are not responsible for delayed or undelivered messages;

  •  You may reply STOP to opt out of automated text messages; and

  •  You may reply HELP or contact 612-208-9551 for assistance.

Consent to receive marketing text messages is not a condition of purchasing or receiving services. Marketing messages, if any, will require any consent mandated by applicable law. Opting out of text messages does not prevent us from contacting you through another permitted method concerning an existing service relationship, safety issue, legal requirement, or requested communication.

12. Acceptable Use

You agree not to use the website to:

  •  Violate a federal, state, or local law;

  •  Submit false, misleading, fraudulent, or impersonated information;

  •  Harass, threaten, exploit, or harm another person;

  •  Attempt to obtain unauthorized access to our systems or data;

  •  Introduce malware, viruses, or harmful code;

  •  Interfere with website operation or security;

  •  Scrape, copy, or extract website content through automated means without permission;

  •  Submit confidential information belonging to another person without authorization;

  •  Misrepresent your relationship with a prospective or current client;

  •  Use our name, logo, or content in a misleading manner; or

  •  Use the website for unlawful advertising, solicitation, or spam.

We may restrict or terminate access to the website when we reasonably believe it is being misused.

13. Intellectual Property

Unless otherwise stated, the website and its content are owned by or licensed to MHA Home Care Services LLC. Protected content may include:

  •  Business names;

  •  Logos;

  •  Text;

  •  Photographs;

  •  Graphics;

  •  Videos;

  •  Forms;

  •  Page designs;

  •  Downloadable materials; and

  •  Other original website content.

You may view or print website content for personal, noncommercial use. You may not reproduce, publish, sell, modify, distribute, display, license, or create derivative works from website content without prior written permission, except as permitted by law. Third-party names, logos, and content remain the property of their respective owners.

14. Testimonials and General Results

Testimonials, reviews, examples, or general statements regarding services represent individual experiences or general information. They do not guarantee:

  •  A particular result;

  •  Improvement in a medical condition;

  •  A particular caregiver match;

  •  Continuous staffing;

  •  Prevention of falls, injuries, hospitalization, or other events; or

  •  That every client will have the same experience.

Care needs, home environments, schedules, health conditions, family involvement, and individual circumstances vary.

15. Third-Party Links and Resources

The website may provide links to third-party websites, government resources, community organizations, social media platforms, employment platforms, or healthcare resources.

A link does not necessarily mean that MHA Home Care:

  •  Controls the third party;

  •  Endorses every statement or service offered;

  •  Guarantees the accuracy of the information;

  •  Accepts responsibility for the third party’s services; or

  •  Guarantees the third party’s privacy or security practices.

Your use of a third-party website is governed by that website’s terms and privacy policies.

16. Website Availability

We may modify, suspend, restrict, or discontinue any part of the website at any time. We do not guarantee that the website will always be:

  •  Available;

  •  Uninterrupted;

  •  Error-free;

  •  Compatible with every device;

  •  Free from harmful components; or

  •  Completely secure.

Scheduled maintenance, technical problems, vendor outages, internet interruptions, security incidents, and events outside our control may affect availability.

17. Disclaimer of Warranties

To the fullest extent permitted by law, the website and its informational content are provided on an “as is” and “as available” basis. MHA Home Care disclaims warranties relating to the website, including implied warranties of merchantability, fitness for a particular purpose, title, and noninfringement. This disclaimer applies to the public website and does not eliminate obligations expressly included in a signed service agreement or obligations that cannot legally be disclaimed.

18. Limitation of Liability

To the fullest extent permitted by law, MHA Home Care Services LLC and its owners, employees, contractors, representatives, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising solely from:

  •  Access to or inability to access the website;

  •  Reliance on general website information;

  •  Website errors or interruptions;

  •  Third-party websites;

  •  Unauthorized website misuse; or

  •  Electronic communications outside our reasonable control.

Nothing in these Terms limits liability that cannot legally be limited, waives a client’s nonwaivable rights, or limits obligations arising under an applicable service agreement, Minnesota home care law, consumer protection law, or other applicable law.

19. Privacy

Use of the website is also governed by our Privacy Policy. By using the website, you acknowledge that internet communications and electronic storage involve security risks and that no online system can be guaranteed to be completely secure.

20. Governing Law

These Terms are governed by the laws of the State of Minnesota, without regard to conflict-of-law principles. Any dispute concerning the public website that cannot be resolved informally will be handled in a court of competent jurisdiction in Minnesota, unless applicable law requires a different location. This section does not prevent a client or consumer from filing a complaint with a government, licensing, regulatory, law enforcement, or consumer protection authority.

21. Severability

If a provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the extent permitted by law.

22. No Waiver

Our failure to enforce a provision of these Terms does not waive our right to enforce that provision or another provision in the future.

23. Changes to These Terms

We may update these Terms periodically. Updated Terms will be posted on this page with a revised “Last Updated” date. Continued use of the website after updated Terms become effective constitutes acceptance of the revised Terms, to the extent permitted by law. Changes to website Terms will not retroactively change a signed client service agreement unless the agreement and applicable law permit the change.
